TERMS OF USE

Last updated: 28 February 2026

Please read these Terms of Use carefully before using our website or placing an order. By accessing www.westofsloane.com (the "Site") or purchasing from us, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, please do not use our Site or services.

These Terms of Use should be read alongside our [Privacy Policy], which forms part of the agreement between us.

1. Who We Are

West of Sloane ("we," "us," "our") is a couture and made-to-measure fashion house registered in Singapore. We design and produce bespoke, semi-bespoke, and made-to-measure garments for clients globally, and we offer our collections for purchase through this Site.

Contact: westofsloane@gmail.com

References to "you" or "your" mean the person accessing or using our Site, whether as a visitor or a purchasing customer.

2. Acceptance of Terms

By visiting our Site, creating an account, placing an order, or engaging our services, you agree to these Terms of Use in full. If you are placing an order on behalf of another person or a business entity, you confirm that you have the authority to bind that person or entity to these terms.

We reserve the right to update or amend these terms at any time. Changes take effect from the date they are published on this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.

3. Using Our Website

3.1 Eligibility You must be at least 18 years of age to use this Site and place an order. By using the Site, you confirm that you meet this requirement.

3.2 Acceptable Use You agree to use our Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the Site. You agree not to:

  • Use the Site in any way that violates applicable local, national, or international laws or regulations
  • Attempt to gain unauthorised access to any part of the Site, its servers, or any system or network connected to the Site
  • Transmit any unsolicited or unauthorised advertising or promotional material
  • Reproduce, duplicate, copy, sell, or exploit any part of our Site or its content without our express written permission
  • Use automated tools, bots, or scrapers to access, extract, or index any content from the Site
  • Introduce viruses, trojans, or any other malicious or harmful material to our Site
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

3.3 Account Registration If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at westofsloane@gmail.com if you suspect any unauthorised use of your account. We reserve the right to terminate accounts at our discretion.

3.4 Website Availability We do not guarantee that our Site will always be available or uninterrupted. We may suspend, withdraw, or restrict access to all or any part of the Site for business or operational reasons without notice. We are not liable if the Site is unavailable at any time.

4. Our Products & Services

West of Sloane offers the following through this Site:

  • Ready-to-order collection pieces from our seasonal collections, produced to your measurements from our set designs
  • Semi-bespoke garments based on our existing designs with personalisation options including fabric colourway, length, neckline, and sleeve variations
  • Fully bespoke and made-to-measure garments designed and produced entirely to your specifications and measurements

All garments are made to order. Unless expressly stated otherwise, we do not hold finished stock. Production of your garment begins only after your order is confirmed, your design is finalised, and applicable payment is received.

4.1 Product Descriptions We make every effort to describe and display our products accurately, including colours, fabrics, and design details. However, due to the limitations of screen display technology, the appearance of fabrics and colours on your device may differ slightly from the finished garment. Fabric samples are available upon request and are strongly recommended for made-to-measure and couture orders.

We reserve the right to make minor adjustments to designs, trims, or fabrication where an originally specified material becomes unavailable, provided any substitution is of equivalent or superior quality. We will notify you of any such change before proceeding.

5. Ordering & Contract Formation

5.1 Placing an Order For collection and semi-bespoke orders, you may place an order directly through our Site. For fully bespoke and made-to-measure commissions, orders are confirmed following a discovery call and design approval process as described in our bespoke client experience pages.

5.2 Order Confirmation Your order constitutes an offer to purchase. A binding contract between you and West of Sloane is formed only when we send you a written order confirmation by email. We reserve the right to decline any order at our discretion, including where:

  • A product is unavailable or out of our current production capacity
  • We are unable to verify payment
  • There has been a pricing error on the Site (see Section 6.2)
  • We reasonably believe an order is fraudulent or in breach of these terms

If we are unable to accept your order, we will notify you promptly and issue a full refund of any payment received.

5.3 Order Amendments Once an order has been confirmed and production has commenced, amendments — including changes to measurements, design details, or delivery address — may not be possible. Please notify us as early as possible if you need to make a change. We will do our best to accommodate requests but cannot guarantee changes once production is underway, and additional charges may apply.

6. Pricing & Payment

6.1 Pricing All prices on our Site are displayed in United States Dollars (USD). Prices are inclusive of applicable taxes where required by law unless otherwise stated. Shipping costs are calculated separately at checkout.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been confirmed.

6.2 Pricing Errors We take care to ensure all pricing on our Site is accurate. In the event of a clear and obvious pricing error, we are not obliged to honour the incorrect price. If a pricing error affects your order, we will contact you to offer the correct price or a full cancellation and refund.

6.3 Payment Payment is accepted via Stripe, PayPal, and Shopify Payments. All transactions are processed securely through these third-party payment providers. We do not store your card details.

For made-to-measure and couture orders, a deposit structure applies:

  • A non-refundable holding deposit is required to commence the design process
  • A further deposit is required upon design approval and before production begins
  • The remaining balance is due prior to shipping unless otherwise agreed in writing

The specific deposit amounts and payment schedule for your order will be confirmed in writing at the time of your discovery call or order confirmation.

6.4 Customs, Duties & Taxes For international orders, your delivery may be subject to import duties, taxes, and customs clearance fees levied by the destination country. These charges are your responsibility and are not included in our prices or shipping fees. West of Sloane has no control over these charges and cannot predict their amount. Please check with your local customs authority before placing an order if you are unsure.

7. Made-to-Measure, Semi-Bespoke & Couture Orders — Special Terms

Given the bespoke and personalised nature of our made-to-measure and couture services, the following additional terms apply to all such orders. Please read this section carefully.

7.1 Design Approval Before production begins, you will receive a design proposal including fabric presentation and, where applicable, design renderings. You are required to review this proposal carefully and provide written approval before we proceed. Once you have given written design approval, we are not able to make changes to the core design elements without additional cost and potential delay to your timeline.

7.2 Measurements For made-to-measure and couture orders, you are responsible for providing accurate measurements. We provide a detailed measurement guide to assist you. If measurements are taken by a third-party tailor, we recommend using a qualified professional.

West of Sloane constructs garments to the exact measurements provided. While we build in standard ease allowances to account for minor variances, we cannot be held responsible for fit issues arising from inaccurately provided measurements. If you are unsure about taking your own measurements, we strongly recommend consulting a local tailor.

7.3 Customisation Limitations Customisation options vary by product type and are clearly stated at the point of purchase or during the consultation process. We reserve the right to decline customisation requests that are technically unfeasible, that would compromise the design integrity of the garment, or that fall outside our production capabilities.

7.4 Production Timeline Estimated production timelines are provided at the time of order confirmation and are given in good faith. These are estimates, not guarantees. Timelines may be affected by factors outside our reasonable control including supplier delays, production complexity, and shipping disruptions. We will notify you promptly of any significant delay. We do not accept liability for losses arising from reasonable production delays.

If your order is for a specific event with a fixed date, please inform us at the earliest opportunity. We will advise whether the timeline is achievable and may offer an expedited production option at an additional cost.

7.5 Final Video Review Prior to shipping, you will receive a video of your completed garment for your review. This is your opportunity to raise any concerns before the garment leaves our production facility. We ask that you review and respond within 5–7 business days. Once you have confirmed satisfaction, or where the review window lapses without response, the garment will be shipped and no further production changes can be made.

8. Your Right to Cancel & Our Returns Policy

8.1 Made-to-Measure, Bespoke & Couture Orders — No Right of Withdrawal

⚠️ Important Notice — Please Read Before Ordering

All made-to-measure, semi-bespoke, and fully bespoke couture garments are produced specifically to your individual measurements and design specifications. These are personalised goods made to your requirements.

Under applicable consumer protection legislation — including the EU Consumer Rights Directive (Article 16(c)), the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and equivalent legislation — the standard right of withdrawal (cooling-off period) does not apply to goods that are made to the consumer's specifications or are clearly personalised.

By placing an order for a made-to-measure, semi-bespoke, or bespoke couture garment, you explicitly acknowledge and agree that:

  • The garment is being produced to your personal specifications and measurements
  • You waive your right of withdrawal under applicable distance selling regulations
  • Deposits paid are non-refundable once design approval has been confirmed in writing
  • Full payment is non-refundable once production has commenced

This does not affect your rights in respect of faulty or misdescribed goods (see Section 8.3).

8.2 Cancellation Before Production Commences If you wish to cancel your order before written design approval has been given and before production has commenced, please contact us immediately at westofsloane@gmail.com. In such cases, we will retain your holding deposit to cover design time and administrative costs already incurred, and will refund any additional payment received.

Once design approval has been given in writing and/or production has commenced, cancellation is not possible and no refund will be issued, except as provided in Section 8.3.

8.3 Faulty, Damaged, or Misdescribed Goods Nothing in these terms affects your statutory rights in respect of goods that are:

  • Faulty or not of satisfactory quality
  • Not fit for the purpose for which they were supplied
  • Not as described

If your garment arrives damaged, defective, or materially different from what was agreed in writing, please contact us within 7 days of delivery at westofsloane@gmail.com with photographs and a written description of the issue. We will assess the matter promptly and, where appropriate, offer a repair, remake, or refund in accordance with applicable law.

8.4 Australian Consumers Nothing in these terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law, which cannot lawfully be excluded or limited. If you are an Australian consumer, our goods come with guarantees that cannot be excluded under the Australian Consumer Law, including that goods are of acceptable quality and fit for purpose.

8.5 Consumer Rights by Jurisdiction Where your local consumer protection laws provide rights that are broader than those stated in these terms, those rights are not affected. These terms apply to the maximum extent permitted by applicable law in your jurisdiction.

9. Shipping & Delivery

9.1 Delivery Timelines Estimated delivery timelines are provided at the time of order confirmation. These are estimates based on standard production and shipping lead times and are not guaranteed delivery dates. We are not responsible for delays caused by shipping carriers, customs authorities, or circumstances beyond our reasonable control.

9.2 Delivery Address You are responsible for providing an accurate and complete delivery address. We are not liable for non-delivery or misdelivery caused by an incorrect address being provided. If a parcel is returned to us due to an incorrect address or failed delivery, you will be responsible for the cost of re-shipment.

9.3 Risk & Title Risk in the goods passes to you upon delivery to your specified address. Title in the goods passes to you upon receipt of full payment.

9.4 Customs & Import International shipments may be subject to customs inspection and delays. We comply with all applicable export laws. You are responsible for complying with the import laws and regulations of the destination country and for paying any applicable duties and taxes (see Section 6.4).

9.5 Lost or Damaged in Transit If your order is lost or damaged during shipping, please contact us at westofsloane@gmail.com as soon as possible. We will work with our shipping partner to investigate and resolve the matter, but we cannot guarantee outcomes that are outside our control.

10. Intellectual Property

10.1 Ownership All content on this Site — including but not limited to our brand name, logo, trademarks, collection designs, design renderings, garment photographs, campaign imagery, written copy, and the overall look and feel of the Site — is the intellectual property of West of Sloane and is protected by applicable copyright, trade mark, and design laws.

10.2 Permitted Use You may access and view content on this Site for your own personal, non-commercial use. You may not, without our prior written permission:

  • Reproduce, distribute, publish, or broadcast any content from this Site
  • Use our designs, images, or brand assets for any commercial purpose
  • Create derivative works based on our designs or content
  • Remove, alter, or obscure any copyright, trade mark, or other proprietary notice

10.3 Customer-Submitted Content By submitting photographs, style references, or other content to us as part of a commission, you grant West of Sloane a limited, non-exclusive licence to use that content for the sole purpose of fulfilling your order. We will not use your submitted content for any other purpose, including marketing, without your explicit written consent.

Where you consent in writing to us sharing images of your completed garment on our website or social media channels, you grant us a non-exclusive, royalty-free licence to use those images for marketing purposes. You may withdraw this consent at any time by contacting us.

10.4 Third-Party Rights We respect the intellectual property rights of others. If you believe that any content on our Site infringes your intellectual property rights, please contact us at westofsloane@gmail.com with full details and we will investigate promptly.

11. Disclaimer of Warranties

Our Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, to the fullest extent permitted by applicable law. We do not warrant that:

  • The Site will be uninterrupted, error-free, or free of viruses or other harmful components
  • The information on the Site is complete, accurate, or up to date at all times
  • The Site will meet your particular requirements

This disclaimer does not affect any statutory rights you may have as a consumer under applicable law, including Australian Consumer Law rights which cannot be excluded.

12. Limitation of Liability

12.1 General Limitation To the maximum extent permitted by applicable law, West of Sloane's total liability to you — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the total amount paid by you for the specific order giving rise to the claim.

12.2 Exclusion of Consequential Loss We shall not be liable for any indirect, consequential, incidental, or special loss or damage, including but not limited to loss of profit, loss of business, loss of opportunity, or damage to reputation, arising from your use of our Site or services.

12.3 Nothing in these terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be limited or excluded by law, including under Australian Consumer Law, the UK Consumer Rights Act 2015, or equivalent consumer protection legislation in applicable jurisdictions

13. Indemnification

You agree to indemnify, defend, and hold harmless West of Sloane, its founders, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Site, your breach of these terms, or your violation of any applicable law or third-party rights.

Our Site may contain links to third-party websites including our social media channels, payment providers, and other services. These links are provided for your convenience only. We have no control over the content, privacy practices, or availability of third-party sites and do not endorse or accept responsibility for them. Accessing third-party sites is entirely at your own risk.

15. Governing Law & Jurisdiction

These Terms of Use and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles.

Subject to Section 16 below, you agree that the courts of Singapore shall have exclusive jurisdiction to settle any dispute or claim arising from these terms or your use of our Site, except where this would conflict with mandatory consumer protection laws applicable in your country of residence.

Consumers in the EU and UK retain the right to bring claims before the courts of their country of residence and to benefit from any mandatory consumer protection provisions applicable under the laws of that country.

Australian consumers retain rights under the Australian Consumer Law that cannot be excluded by the choice of governing law.

16. Dispute Resolution

We hope that any concerns you have can be resolved by contacting us directly at westofsloane@gmail.com. We are committed to responding to all enquiries within 5 business days and to working in good faith to resolve any issues.

If a dispute cannot be resolved informally, both parties agree to attempt mediation before commencing formal legal proceedings, where this is required or appropriate under applicable law.

Nothing in this section prevents you from exercising any statutory right you may have to refer a complaint to a relevant consumer protection authority or alternative dispute resolution scheme in your jurisdiction, including:

  • UK: The relevant Alternative Dispute Resolution (ADR) scheme or the courts of England and Wales
  • EU: Your national consumer protection authority or the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr
  • Australia: The Office of the Australian Information Commissioner or relevant state consumer protection authority
  • UAE: The Consumer Protection Department of the UAE Ministry of Economy

17. Severability

If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remaining terms, which shall continue in full force and effect.

18. Entire Agreement

These Terms of Use, together with our Privacy Policy and any written order confirmation, constitute the entire agreement between you and West of Sloane in relation to your use of the Site and purchase of our products. They supersede all prior representations, agreements, and understandings, whether written or oral.

Accessibility Statement

Last reviewed: 28 February 2026

Our Commitment to Accessibility

West of Sloane is committed to ensuring that our website is accessible to everyone, including people with disabilities. We believe that every visitor to our Site deserves a seamless, dignified experience — regardless of how they access the internet.

We are actively working to improve the accessibility of www.westofsloane.com in accordance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA — the internationally recognised standard for web accessibility — as well as applicable legal requirements in the jurisdictions we serve, including:

  • Singapore: Infocomm Media Development Authority (IMDA) web accessibility standards
  • United Kingdom: Equality Act 2010 and Public Sector Bodies (Websites and Mobile Applications) Accessibility Regulations 2018
  • European Union: EN 301 549 accessibility standard and the Web Accessibility Directive
  • United States: Americans with Disabilities Act (ADA) and Section 508 of the Rehabilitation Act
  • Australia: Disability Discrimination Act 1992 and WCAG 2.1 guidance

Current Accessibility Features

Our website is built on Shopify, which incorporates a number of accessibility features as part of its platform infrastructure. We have taken additional steps to make our content as accessible as possible, including:

Visual Accessibility

  • Text contrast ratios are designed to meet or exceed WCAG 2.1 Level AA minimum contrast requirements
  • Text can be resized up to 200% using standard browser controls without loss of content or functionality
  • We avoid using colour alone to convey important information
  • Decorative images are marked appropriately so they are not read aloud by screen readers

Navigation & Interaction

  • Our Site is designed to be navigable using a keyboard alone, without requiring a mouse
  • Focus indicators are visible when navigating via keyboard
  • Interactive elements — including buttons, links, and form fields — are clearly labelled
  • Our Site is structured with semantic HTML headings to assist screen reader users in navigating content

Content

  • We aim to write in plain, clear English throughout our Site
  • Alternative text (alt text) is provided for informational images
  • Form fields are labelled to assist screen reader users
  • Error messages are descriptive and clearly identify what action is needed

Media

  • Where video content is published on our Site, we endeavour to provide captions or transcripts

Known Limitations

While we strive to meet WCAG 2.1 Level AA standards, we acknowledge that some areas of our Site may not yet fully meet this standard. Known limitations include:

  • Third-party content: Our website integrates with third-party platforms including payment providers (Stripe, PayPal, Shopify Payments), social media embeds (Instagram, Meta), and analytics tools (Google Analytics). These are operated by external parties and may not meet the same accessibility standards as our own content. We have no direct control over their accessibility but encourage those providers to maintain accessible services.
  • Product imagery: Our lookbook and campaign photography is integral to the experience of our brand. We provide descriptive alt text for all product and editorial images to support screen reader users.
  • PDF documents: Any downloadable documents (such as lookbooks or order forms) may not be fully accessible. If you require a document in an alternative format, please contact us and we will assist you directly.

We are committed to continuous improvement and are actively working to address these limitations over time.

Alternative Ways to Access Our Services

If you encounter any accessibility barrier on our Site or if our website does not work well with your assistive technology, we want to ensure you can still access our products and services fully.

Please contact us directly and we will assist you by alternative means:

📧 Email: westofsloane@gmail.com — we are happy to provide product information, process orders, share lookbooks, or conduct consultations entirely by email if that is more accessible for you.

We will respond to all accessibility-related enquiries within 3 business days.

We do not want accessibility challenges to prevent anyone from experiencing West of Sloane, and we are committed to finding a solution that works for you.

Feedback & Reporting Accessibility Issues

We welcome your feedback. If you experience any difficulty accessing any part of our Site, or if you notice an accessibility issue we have not addressed, please let us know:

Email: westofsloane@gmail.com Subject line: "Accessibility Feedback"

In your message, please include:

  • The page or feature you were trying to access
  • The assistive technology or browser you were using (if known)
  • A description of the issue you experienced

We take all accessibility feedback seriously and will review and respond to your report within 5 business days. Where issues are confirmed, we will work to resolve them as promptly as possible and will update you on our progress.

Our Ongoing Commitment

Accessibility is not a checkbox — it is an ongoing practice. We are committed to:

  • Reviewing this accessibility statement and our Site's accessibility at least annually
  • Including accessibility considerations in all future website updates and design decisions
  • Seeking feedback from users with disabilities to continuously improve our Site
  • Staying informed about evolving accessibility standards and best practices

This statement was last reviewed on 28 February 2026. We intend to conduct a formal accessibility audit of our Site in 2028 and will update this statement with the findings.

West of Sloane acknowledges that achieving full WCAG 2.1 Level AA conformance is an ongoing process. We are committed to making progress and to ensuring that no visitor to our Site is excluded from the West of Sloane experience.
